I Aaron Collett of Stonehouse in the County of Gloucester carpenter and wheelwright being of sound and disposing mind memory and understanding do make publish and declare this to be my last Will and Testament expenses to be paid by my Executors hereinafter named out of the first monies which shall come to their hands by virtue of this my Will.

 

I give devise and bequeath unto my Daughter Nancy her heirs and assigns for ever all those of my Cottages or Tenements Gardens and Hereditaments situate and being in the Parish of Stonehouse aforesaid now in the several occupations of William Clarke and Giles Collier and which are in mortgage to Mr Cave for securing sixty pounds and interest.

 

And I declare that in case the before mentioned or any other mortgage debt shall be secured thereon at the time of my decease the said Nancy Collett shall discharge such mortgage debt and that she shall not be entitled to claim payment of the same or any part thereof out of any part of my real or personal Estate not devised or bequeathed to her by this my Will.

 

And I declare that the said Cottages and Hereditaments shall be taken by the said Nancy Collett in lieu and full satisfaction and discharge of any money which I now owe or which at the time of my decease I may owe her.

 

I give and bequeath unto my son Martin Collett his Executors Administrators and Assigns all and singular my Business and Stock in Trade working Tools Implements and Effects now being in upon and about my Workshop and on the premises adjoining thereto situate and being in the Parish of Stonehouse aforesaid to and for his own use.

 

And I give devise and bequeath all the rest residue and remainder of my freehold copyhold and personal Estate whatsoever and wheresoever not hereinbefore disposed of unto my dear wife Sarah Collett and her assigns for her natural life subject nevertheless to the several mortgage debts now due thereon or on some part thereof the interest whereof from time to time to accrue due thereon I direct shall be paid by my said wife for her life and subject also to the payment of my just debts funeral and testamentary expenses and from and immediately after the decease of my said wife.

 

I give devise and bequeath the said residue and remainder of my freehold leasehold copyhold and personal Estate unto my Friends John Stephens of Ebley Baker and Walter Cadogan of Stonehouse Glazer their Heirs Executors Administrations and Assigns according to the nature and quality thereof respectively upon trust with all convenient speed after the decease of my said wife absolutely to sell and dispose of the said Estate or so much thereof as shall not consist of money either in one lot or in several lots by public auction or private contract or partly by public auction and partly by private contract to any person or persons willing to purchase the same and to such price or prices as to the said Trustees shall form reasonable and for promoting and facilitating such sale or sales to enter unto make and execute all such contracts conveyances surrenders or assurances acts and deeds as the said Trustees or Trustee for the time being shall think proper.

And I direct that the said Trustees or Trustee for the time being shall with and out of the said monies pay and satisfy my just debts particularly such of the said mortgage debts or debt as may be due on the residue of my said Estates at the time of such sale as assigned together with all arrears interest (if any) then due for the same and after such payment In trust that they the said Trustees or Trustee for the time being do act shall pay and divide the residue of the said monies equally unto between and among my children the said Nancy Collett Sarah Collett John Collett Martin Collett and Martha James the wife of Samuel James or such of them as shall be living at the decease of my said wife.

 

And I declare that the receipts of the said John Stephens and Walter Cadogan or the survivor of them his Executors Administrators or Assigns shall be good discharges for all monies which in such receipts shall be expressed to be received and that all persons paying any monies to the said John Stephens and Walter Cadogan or the survivor of them his Executors Administrators or Assigns for the purpose of this my Will and taking a receipt from him or them accordingly shall not be obliged to see to the application of the source monies nor to be accountable for the misapplication thereof and that the Trustees or Trustee for the time being shall not be answerable to one or other of them or for the acts deeds or defaults of the other of them nor for involuntary losses and for money accrued under receipts in which they shall join only for conformity and that the Trustees or Trustee for the time being shall and may reimburse themselves out of the said trust premises or out of any monies which may come to their hands by virtue of this my Will all costs and expenses to be incurred by them in the execution of the trusts aforesaid or any wise in relation thereof.

 

And I appoint the said John Stephens and Walter Cadogan joint Executors of this my Will and I hereby make all other Wills by me at any time heretofore made and do declare this to be my last Will and Testament In Witness whereof I have hereunto set my hand and seal the nineteenth day of January in the year of our Lord one thousand eight hundred and thirty five.

 

Signed sealed published and declared by the said Aaron Collett the Testator as and for his last Will and Testament in the presence of us who in his presence and in the presence of each other have subscribed our names as witnesses thereto.

 

 

The Will was witnessed by Kenard Gardiner of Stonehouse, George Spearing of Stonehouse, and J H Warman solicitor of Stonehouse and

was signed by Aaron Collett in his own hand

 

 

Aaron’s wife was Sarah Stephens (Ref. 1M33) and his children were:
